Terms and Conditions
Welcome to Curby. By subscribing to or using our services, you agree to be bound by these Terms and Conditions, as well as our Privacy Policy, and our Recurring Payment Agreement.
1. The Service Relationship
Curby LLC (“Curby,” “we,” “us”) is a direct service provider. All bin management and cleaning services are performed by Curby employees who are background-checked and professionally trained. We are not a tech marketplace; we are the ones doing the work.
2. Access & Authorization
By subscribing, you grant Curby and the Curby Crew authorization to access your property (including fenced yards or garages, if applicable) solely to service your bins.
- Right to Access: You confirm you have the legal right to grant us access to the property.
- Obstructions: You must provide unobstructed access. If we cannot reach your bins due to locked gates, pets, or blocked paths, service will be skipped, and no credit or refund will be issued.
- Garage Access: If you provide a garage code, you assume all risks. Curby is not responsible for lost items, garage door malfunctions, or alarms triggered by our entry/exit. You are responsible for disabling security systems during service windows.
3. Service Standards & Safety
- Bin Condition: For the safety of our Crew, we will not move bins that are excessively heavy, overflowing, or leaking hazardous materials.
- Cleaning Fees: If you have a cleaning plan and the bin is found to be excessively contaminated (e.g., unbagged animal waste, chemicals), a $50 Contamination Fee may apply.
- Pets: All pets must be secured. If a Crew member feels unsafe due to an unrestrained animal, service will be denied without a refund.
4. Billing, Cancellation & Refunds
4.1 Pricing: You agree to pay the current service fee plus any applicable taxes for your selected plan. Curby reserves the right to modify pricing with 30 days' notice.
4.2 Recurring Payment Authorization: By subscribing, you provide your electronic signature and authorize Curby LLC to:
- Store your payment method securely via our third-party processor.
- Automatically charge your designated payment method at the start of every billing cycle (monthly, quarterly, etc.) until you cancel.
- Re-attempt collection if a payment fails.
- You may cancel this authorization at any time by following the procedures in Section 4.3 below, though doing so will terminate your service.
4.3 Cancellation Notice: * Standard: 5 Business Days’ notice is required before your next billing date.
- Enterprise Clients (50%+ of properties): 30 days’ notice is required.
4.4 No Partial Refunds: We do not offer prorated refunds for mid-cycle cancellations. Service will continue until the end of your paid period.
5. Limitations & Force Majeure
- Service Delays: We are not liable for missed pickups due to municipal schedule changes, extreme weather, road closures, or technology outages. No refunds are issued for "Acts of God."
- Liability Cap: Curby’s total liability for any claim is limited to the amount you paid for the service in the 12 months preceding the claim. We are not liable for HOA fines, property damage from third-party vehicles, or "normal wear and tear" on bins.
6. Legal Protections
- Indemnification: You agree to indemnify and hold Curby LLC harmless from any claims, damages, or expenses (including legal fees) arising from our access to your property or your breach of this agreement.
- Dispute Resolution: Any disputes arising from this agreement shall be resolved through binding arbitration in Snohomish County, Washington, rather than in court.
- Governing Law: This agreement is governed by the laws of the State of Washington.
- Severability: If any part of this agreement is found unenforceable, the remaining sections remain in full effect.
7. Short-Term Rentals (STRs)
For STR properties, the Customer is solely responsible for HOA compliance regarding bin placement. You agree to pay any fines or penalties resulting from bin placement that follows your service instructions.
